Commission Agreement and Terms of Service

Disclaimer: by commissioning Zepheren you are acknowledging you have read and are agreeing to the following terms and conditions. Please ensure you have read the following information provided carefully. If there are any questions or concerns, please contact Zepheren. Do be aware that this document is subject to edit and changes as the seller, Zepheren, expands and branches into different fields of commission work.

General Information
-Zepheren provides a specialization in feminine, fantasy/anime characters. If the request is outside of these fields, the artists reserves the right to request more time for your commission.General Disclaimer
-I, Zepheren, reserve the right to refuse or discontinue a commission at any time.
-Disrespectful behavior will not be tolerated and your commission will be cancelled if it occurs.

-Zepheren only provides digital art commission work. You, the buyer, shall receive a digital file containing your commissioned artwork. Do be aware that there will be no physical copies of the artwork included.Payment and Fees
-Payment must be in USD via Ko-fi or Paypal. At this time Zepheren isn't accepting alternative payment methods and thanks you for understanding.
-Before commission work begins, client shall pay 50% of total commission price up front. If client is unable to pay at the time of request, then Zepheren will exercise the right to turn down the commission until the client is able to pay.
-At this time, zepheren does not have a set rush fee. if you, the client, have a deadline you require a commission before the one provided by zepheren, then a rush fee may be requested. Rush fees, depending on the complexity of the commission can range anywhere between 15-20% of the total commission price.
-A design fee will be charged for clients with no solid reference images available. This price is based on the artist during initial interation and commission detail requests.Client Obligations
-Write in a clear and concise manner when writing the commission request.
-Please provide multiple clear reference images of the character/subject. Mood boards are welcome!
-Maintain professional conduct through out the commission process.
-Respond in a timely fashion.
-Assume responsibility for any important information and clear descriptions/references you fail to provide Zepheren that will result in the inablility to compleate the clients commision to their full satisfaction.-------------------------Process and Work Schedule-Upon first payment, Zepheren will begin work on an inital sketch. There could be several versions, so ensure you reply in a timely manner. At this stage you can approve or require adjustments if necessary. A minimum of three revisions will be provided in the sketching phase.
-During the lineart phase/painting phase any revisions requested may delay commissioned artwork, and depending on the adjustment require additional fees up to 25% of original commission cost.
-Sizing of commissioned work is traditionally the following HD formats at 500 DPI.
-- Square (2000x2000)
-- Portrait (2160x2700)
-- 4k Landscape: (3840x2160)
-Sketches and subsequent in-progress shots will initially be sent as low-res, watermarked images.
-Deadlines must be agreed upon prior to the start of the commission. At this time, commissions may take up to 1-4 weeks.
-Zepheren will always do his best to complete your commission within a timely manner, but please understand that sometimes life may get in the way and cause a delay in completing your commission. I will notify you as soon as possible of any issues that come up to keep you informed.
-A link will be provided to view Zepheren's Schedule to view work progress upon the start of the commission.--------------------Copyright and Usage Policy
- I, the artist, retain the rights over any commissioned works.
- I reserve the right to post the commissioned work on my social media.
- I reserve the right to stream, record, and upload videos of the creation of the artwork.
- Any character portrayed in the commissioned work remain copyrighted to their rightful owners.
- The final product is strictly for your personal use only, unless you purchased commercial rights.
- You must credit and link back to me/tag me when sharing or using the commissioned work.
- Credit is still required when using the work in any form commercially.You may use or edit the commissioned work in the following ways
- Print the work for personal use
- Crop and/or resize the image for use as an avatar, header, video thumbnail, etc.
- Use the artwork as reference for a study.
- Post the artwork on social media, with credit to me clearly visable.You may NOT use or edit the commissioned work in the following ways
- Claim the artwork as your own.
- Remove my watermark/signature.
- Paint over or otherwise alter the artwork in ways not covered under the allowed uses above.
- Color in my sketches or lineart.
- Use the commissioned piece in any technology related to NFTs, cryptocurrency, or AI.
- Reproduce the work commercially without purchasing the rights.Cancellation and Refunds
- Once the final product is approved, a refund is not permitted.
- You may cancel the commission any time, after which I will issue a refund equivalent to the amount of work not done.
- I reserve the right to cancel and refund the money for your commission at any time.
- You may not file a chargeback against me after you have given approval of the artwork.____________________________What You ReceiveYou will receive the following after client approvals at the appropriate stages of the commission process. Images are always sent as 500 DPI PNGs unless another resolution/file type is requested:Final sketchFlat color sketch (not available for all commission types)Final artworkFor an additional $50 USD, you can also purchase the PSD or CSP file of your commission.Commercial Rights will be cost 100% of commission cost.
